Dismissal may be discriminatory even if employer did not know about disability until appeal hearing
The Employment Appeal Tribunal has held that a dismissal may be discriminatory, where an employer did not know about an employee’s disability at the time of dismissal, but was told about it at an appeal hearing.
System for measuring working hours of all workers is required
The European Court of Justice has held that Member States must require employers to have a system for measuring the actual hours worked each day for individual workers in order to comply with the Working Time Directive’s provisions on maximum weekly working time and daily and weekly rest.
